Ad Posting Policy

As a condition of your use of Faydaindia website, its content and related services (hereafter “Platform”), you agree that you will not post any material, content or information, including goods and services, for sale, donation or exchange, that violates the laws of Republic of India and/or is not permitted according to the (A) Prohibited Items Policy and (B) Prohibited Activities Policy listed below.    

1. Prohibited Items Policy

You are prohibited from posting the following items on Faydaindia Platform:

• Adult Content, including any form of pornography, paedophilic material, material that portrays nudity and/or human genitalia and/or is sexually offensive, repulsive or obscene. Any form of prostitution, escort services or accompanying services including those that violate the provisions of the Immoral Traffic Prevention Act 1986. Post any form of media that degrades a minor (below the age of 18 years), in a manner that may violate the provisions of the Protection of Children from Sexual Offences Act, 2012.
• Alcoholic Beverages and Illegal Drugs, including liquors, drugs, drug paraphernalia including steroids, cannabis, cannabis-based extracts, narcotics, intoxicants, psychotropic substances, tobacco products, medicines, hookahs, pipes, bongs, vaporizers and/or its promotion, service and delivery, including all items listed under the Narcotic Drugs and Psychotropic Substances Act, 1985.
• Burglary Tools
• Computer Viruses, Trojans and Hacking Devices, including products, services, links and material that may breach personal computer(s), corporate networks, Wi-Fi systems, database servers and/or any other digital devices that may violate the provisions of the Information Technology Act, 2000.
• Counterfeit, Pirated and Stolen Items and Distribution of Trademarked and Copyrighted Material, including sale of counterfeit currency, coins, financial records, counterfeit products, personal items, in accordance with the Digital Media Ethics Code Rules, 2021, the Prevention of Money Laundering Act, 2002, the Copyright Act, 1957 and the Trade Marks Act, 1999.
• Digital Items or Accounts, including gaming accounts, digital copies of movies, books or software, software keys, codes or passwords.
• Financial Instruments, including shares, bonds, debentures and in accordance with the Securities Contract Regulation Act, 1956.
• Fireworks and Explosive Devices
• Government Issued Identity Documents, Military or Police Badges, Uniforms and Licenses, including material that infringes any parent, trademark, copyright or intellectual rights.
• Hazardous Chemicals, including acids, pest control products and sprays, environment unfriendly agents and harmful compounds including those chemicals that may violate the Hazardous Chemicals Act, 1985.
• Illegal Antique Products that may violate the Antiquities and Art Treasurers Act, 1972.

• Illegal Surveillance Devices that can intercept private or military communications and/or those that harm the national interest of India.
• Lottery Tickets, Sweepstakes Entries and Gambling Slot Machines
• Offensive and Obscene Material, including spam and fraud plans that intent to defraud users.
• Organs, Body Fluids and Body Parts, including surrogacy, fertility, and donor requests.

• Prescription Drugs and Devices, including medicines and drugs that may violate the Medicines Advertisement and Sales Act, 1956.
• Pyramid Schemes and/or Financial Scam Schemes, including related marketing services and offers intended to cheat users.
• Religious items, including religious books, digital media, links to religious opinions, discussions, threats or topics of “hate speech” that may discriminate against any person, group, race or religion.
• Restricted Food Items, including food adulteration agents and other related products that may violate the Food Adulteration Act, 1954.
• Weapons and Firearms, including, but not limited to, firearm ammunitions, magazines, firearm parts, tear gas, stun guns, knives, martial arts weapons, replica weapons, and items that are prohibited under the Indian Arms Act, 1959.

• Wildlife Items, including those that are defined under the Wildlife Protection Act, 1972 and the Environment Protection Act, 1986.

1. Prohibited Activities Policy

You are prohibited from conducting the following activities on Faydaindia Platform:

• Posting multiple listings of the same item.
• Posting duplicate ads in multiple categories.
• Posting ads using multiple different email addresses and/or phone numbers.
• Posting an ad in incorrect or misleading category or with misleading information.
• Posting an ad with the express intention of spamming or keyword spamming the website.
• Posting photos in the ad or in personal profile that does not belong to you.
• Posting ads that violates Faydaindia’s Pet Posting Policy.
• Posting an ad for items that is not available to be inspected or picked up in person or inspected virtually during Covid-19.
• Posting job ads and/or services offers for applicants below 18 years of age.
• Posting job ads that require down payment in any form including gifts or favours.
• Posting ads for jobs that involve human slavery, bonded labour work, child labour including those that violate the Child Labour Prohibition and Regulation Act, 1986 and Bounded Labour System (Abolition) Act, 1976.
• Posting ads for sale that is illegal to own, buy or sell.

Strict Action for Non-compliance of Faydaindia Policy

As a general rule, you are responsible for ensuring compliance with all applicable laws relating to the items you post, buy or sell. To safeguard the safety and security of our user community, we believe in strict action against policy violations and may take the following actions as appropriate:

• Immediate removal of your ad from the platform.
• Permanent ban on access to platform and affiliated service.
• Immediate termination of your account.
• Report to law enforcement authorities if required.
• Take legal action if required.

You acknowledge and agree that Faydaindia reserves the right at any time to modify, limit or discontinue service with or without notice and that Faydaindia shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the service. You acknowledge and agree that Faydaindia, in its sole and absolute discretion, has the right to delete or deactivate your account, block your e-mail or IP address, or otherwise terminate your access to or use of the service, immediately and without notice, and remove any content within the Service, for any reason or no reason at all, including, without limitation, if Faydaindia believes that you have violated these Terms. Further, you agree that Faydaindia shall not be liable to you or any third-party for any termination of your access to its services.
