Terms of Use

The Faydaindia Platform is provided to you by Edatamantra LLP, with its registered office at F2 Ayojan Nagar Society, Shreyas Railway Crossing, Vasana, Ahmedabad, Gujarat 380007, India. When using the Platform, you understand and agree to abide by all applicable terms listed here in these legally binding Terms and Conditions (hereafter “Terms”). If you do not accept these Terms in full, you may discontinue using Faydaindia Platform and related services. 

Using Faydaindia

1. Acceptance of Terms

These Terms constitute a legally binding agreement made between “you” and “your”, whether personally or on behalf of “you” and Faydaindia (“we,” “us” or “our”), concerning your access to and usage of the Faydaindia website as well as any other media form, media channel, or mobile application related service, linked, or otherwise connected, hereto (collectively, the “Platform”). Failure to comply with any of the stipulated Terms may result in the permanent termination of your account and access to the Platform.

2. Using Faydaindia Content

Faydaindia is an internet-based electronic platform providing ad posting services, where users can post and respond to classified ads. The user is solely and legally responsible for the content of the ad, including messages, chat, text, mobile numbers, email addresses, photographs, graphics, videos, or other materials (“Content”) posted on, transmitted through, or linked on this platform, and must bear all risks associated with the use of any Content.

Edatamantra does not pre-screen, approve or control the Content posted by the users and is not involved in any contract, transaction, operation, management, or arrangement that may occur between the users and the third parties.

3. Faydaindia Intellectual Property

Faydaindia Platform is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform and the trademarks, service marks, and logos contained are owned or controlled by us or licensed to us, and are protected by copyright, trademark laws and intellectual property rights.

4. Modifications to this Agreement

We reserve the right and sole discretion to change modify or alter these Terms at any time. You are advised to review this agreement on a regular basis.

5. Advertising Purchases and Payments for Premium Ad Plans and Services

Users may purchase premium ad plans for their advertisements. If the user decides to remove or delete the posted advertisement before the purchased time frame has lapsed, Edatamantra will revoke the right of the user to reuse the rest of the “unused” purchased time. Edatamantra does not reimburse the user for any portion of a discounted premium ad plan, service or feature.

6. Electronic Communications

When you register with Faydaindia Platform as a member user, you consent to receive communications from us electronically, such as e-mails, SMS, text messages, mobile push notices that uses your email address and/or mobile phone number supplied to us at the time of registration. You agree that all notices, agreements and other communications that we send to you electronically satisfy any legal requirement.

7. Third-Party Websites and Content

Faydaindia may contain features, functionality or links to other websites (“Third-Party Websites”) however, Faydaindia is not responsible for those sites, their content or their privacy policies. These Terms does not apply to any web pages not under a domain owned and operated by Edatamantra, regardless of any hyperlinks from a web page under our domains to external web pages.

Please read our Privacy Policy, which also governs the use of Faydaindia Platform.

9. Disclaimer of Warranties and Limitation of Liability

THE FAYDAINDIA WEBSITE, ITS CONTENT, AND RELATED SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE FAYDAINDIA PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR INFORMATION AND PERSONAL USE ONLY. EDATAMANTRA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF FAYDAINDIA PLATFORM OR THE CONTENT, INFORMATION OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU VIA THE FAYDAINDIA PLATFORM. YOU CONSENT TO AGREE THAT YOUR USE OF THE FAYDAINDIA PLATFORM IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY LAW, Edatamantra disclaims all warranties, representations, and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, or fitness of the goods and services and Content posted on the Platform, but that Edatamantra shall have the right (but not the obligation) in its sole discretion to modify, delete or move any Content posted on the Platform for violating this agreement, laws and local authority regulations or for any other reason. Edatamantra WILL not BE liable for any loss of money, goodwill, reputation that may arise from the usage of Faydaindia Platform.

FAYDAINDIA DOES NOT CONTROL THE CONTENT PROVIDED BY THIRD PARTY OWNERS AND DOES NOT GUARANTEE THE ACCURACY, INTEGRITY OR QUALITY OF SUCH CONTENT. YOU UNDERSTAND THAT BY USING FAYDAINDIA PLATFORM, YOU MAY BE EXPOSED TO CONTENT PROVIDED BY THIRD PARTY OWNERS THAT IS OFFENSIVE, INDECENT AND/OR OBJECTIONABLE. UNDER NO CIRCUMSTANCES WILL FAYDAINDIA BE LIABLE IN ANY WAY FOR ANY CONTENT PROVIDED BY THIRD PARTY OWNERS, INCLUDING ANY ERRORS OR OMISSIONS IN ANY SUCH CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY SUCH CONTENT. IN NO EVENT SHALL FAYDAINDIA OR ANY THIRD PARTY OWNER OR ANY OF THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS BE LIABLE TO YOU OR TO ANYONE ELSE FOR (1) ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, CONSEQUENTIAL DAMAGES OR ANY OTHER LOSS IN CONNECTION WITH YOUR ACCESS OR USE OF THE FAYDAINDIA PLATFORM OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR (2) ANY NEGLIGENCE, INCLUDING ANY GROSS NEGLIGENCE, IN CONNECTION WITH THE FAYDAINDIA PLATFORM OR ANY CONTENT.

10. Conduct

 By using the Platform, you agree that:

• You are 18 years of age or above and has the legal capacity to comply with these Terms.
• You will not post content that is unsafe, unlawful, harmful, abusive, harassing, defamatory, intimidates or libellous to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability.
• You will not to post content that is false, inaccurate, deceptive, misleading, deceitful, or impersonates any person or includes personal or identifying information about another person without that person’s express consent.
• You will not post any content that infringes any patent, trademark, trade secret, copyright or intellectual property of any party or that it does not violate any applicable law, code or regulation.
• You confirm that you have the express rights to the images, graphics, photographs, videos illustrating your ad.
• You will not access the Platform through automated means, whether through a bot, script, crawlers, computer code or otherwise.
• You will not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit for any commercial purpose whatsoever any part of the Platform or its content.
• You will not circumvent, disable, or otherwise interfere with security-related features of the Platform, including features that prevent or restrict the use of the Platform or its content.
• You will not use the Platform for any illegal or unauthorized purpose.
• You will not make improper use of Faydaindia support services or submit false reports of abuse or misconduct.
• You will not collect personal data about other users for commercial or illegal purposes.
• You will not sell or transfer your profile.
• You will not post multiple listings for the same item.
• Edatamantra has the right to suspend or terminate your account, membership or plan and refuse any and all current or future use of the Platform (or any portion thereof).

11. Violation of Terms

Please report and violations of the Terms, by flagging the posting(s) for review or by sending an email at help@faydaindia.com. We believe in strict action against policy violations and may take the following actions as appropriate:

• Immediate removal of your ad from the Platform.
• Permanent ban on access to Platform and affiliated service.
• Immediate termination of your account.
• Report to law enforcement authorities if required.
• Take legal action if required.
